Drydock Terms of Service — Cover Page

This Cover Page, together with the Common Paper Cloud Service Agreement Standard Terms Version 2.0 (“Standard Terms”, available at commonpaper.com/standards/cloud-service-agreement/2.0/), forms the agreement (“Agreement”) between the Provider and the Customer named below. By signing up for or using the Service, you agree to this Agreement.

The Standard Terms are licensed under CC BY 4.0 by Common Paper, Inc. and are incorporated into this Agreement by reference. Capitalized terms used here have the meanings given in the Standard Terms unless defined here.

Modifications to the Standard Terms

The following modifications apply to the Standard Terms. Where a modification conflicts with the Standard Terms, this Cover Page controls.

  1. Service warranty (Section 1.2 of Standard Terms). The Service is provided “AS IS” and “AS AVAILABLE”. Provider does not warrant uninterrupted or error-free operation. No service level agreement is offered for the Subscription Period unless one is explicitly attached to the Order Form.
  2. Customer responsibility for the VM. Customer is granted root access to the virtual machines provisioned through the Service. Customer is solely responsible for the security, configuration, contents, and lawful operation of those virtual machines, including all software installed on them and all network traffic originating from them. Provider has no obligation to back up or recover Customer Data stored on the virtual machines.
  3. Suspension for AUP violations. In addition to the suspension rights in the Standard Terms, Provider may immediately suspend or terminate the Service, with or without notice, if Provider reasonably believes Customer is violating the AUP, if Customer's use threatens the security or availability of the Service or third-party systems, or if Provider receives a credible abuse complaint. Provider is not required to issue refunds for periods during which the Service is suspended for AUP violations.
  4. No refunds for partial periods. Fees paid for the current Subscription Period are non-refundable, except as required by law or expressly stated in the Standard Terms.
  5. Export and sanctions. Customer represents that it is not located in, and is not a national or resident of, any country or region subject to a comprehensive U.S. embargo (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and is not on any U.S. government denied-party or sanctions list.
  6. Eligibility. Customer must be at least 18 years old (or the age of legal majority in Customer's jurisdiction) and capable of forming a binding contract.
  7. DMCA. Provider's designated DMCA agent and the procedure for filing a copyright takedown notice or counter-notice are described at drydock.build/legal/dmca.
  8. Changes to this Agreement. Provider may update this Cover Page, the AUP, and the Privacy Policy from time to time. Material changes will be announced in the dashboard or by email at least 14 days before they take effect. Continued use of the Service after the effective date of an updated Cover Page constitutes acceptance of the update.
